Rules & Regulations for Crofton Country Club

Article 1

General Provisions
 
1.1 Name and Purpose: Crofton Country Club (“Club”) has been formed to permit Members and their guests to utilize the Golf Course, Clubhouse, Swimming Pool and other recreational facilities at Crofton Country Club.
 
The Club facilities and golf course will be closed to Members every Monday unless otherwise posted by management.
 
Article 2
 
Rights, Privileges, Obligations, Etc.
 
2.1 Rights and Privileges: The privileges of the Club with respect to each category of membership are as follows:
(a) Individual Full Golf Members
 
(i) Use of the Golf Course by the Member without the obligation to pay any green fees.
 
(ii) Use of the golf practice facilities by the Member without the obligation to pay any driving range or similar fees, other than the Club Plan.
 
(iii) Use of all the facilities in the Clubhouse by the Member and his/her family.
 
(iv) Use of the Swimming Pool and related facilities by the Member and his/her family.
 
(v) Use of the club storage (limit of one bag) by the Member without the obligation to pay any storage or similar fees, other than the Club Plan.
 
(vi) Use of a locker by the Member (limit of one locker) which is subject to an annual locker fee (based on availability).
 
(b) Couple Full Golf Members
 
(i) Use of the golf course by the Member and his/her spouse, without the obligation to pay any green fees.
 
(ii) Use of the golf practice facilities by the Member and his/her spouse without the obligation to pay any driving range or similar fees, other than the Club Plan.
 
(iii) Use of all the facilities in the Clubhouse by the Member and his/her family.
 
(iv) Use of the Swimming Pool and related facilities by the Member and his/her family.
 
(v) Use of the club storage (limit of two bags, Full Golf only without additional charge) by the Member and his/her spouse.
 
(vi) Use of a locker (limit of two lockers) by the Member and his/her spouse, which is subject to an annual locker fee (based on availability).
 
 
(c) Social Members
 
(i) Use of all the facilities in the Clubhouse, with the exception of lockers, by the Member and his/her family
 
(ii) Use of the Swimming Pool and related facilities by the Member and his/her family.
 
2.2 Guests: Member may sponsor a guest to utilize privileges of the Club associated with Member’s category of Membership in the Club. Notwithstanding the foregoing, Members may not sponsor any one (1) person as a guest to utilize the Golf Course more than one (1) time during any calendar month, regardless of who the host Member is. Guest fees shall be established by the Owner from time to time. Members shall be responsible for the acts and omissions of their Guests while utilizing the Club facilities and for all charges, fees, services, and food and beverage purchases by such Guests. Also, Guests must be accompanied by the sponsoring Member.
 
2.3 Dues, Club Plan and Locker Fees:
 
(a) Members of the Club are obligated to pay dues, club plan, and/or lockers fees in such amounts as may be determined by the Owner from time to time. Dues are annual January – December and may be payable in monthly installments from January through December each year. Certain incentives may be offered to Members for the pre-payment of dues on an annual basis. The Club Plan and locker fees will be billed once a year in January or upon joining the Club.
 
(b) The Owner also reserves the right to adopt a multi-tiered dues structure. The level of dues will be based on the number of persons in the Family of a member that are designated by such Member to enjoy the privileges of the Club plan and/or locker fees.
 
(c) Any membership status changes, for any membership category (including Social Membership) must be submitted to the Membership Director in writing, 30 days in advance of the requested change. This includes upgrades, downgrades and resignations. We are not responsible for letters that do not reach the club in a timely manner.
(d) All membership categories, including Social Membership remain open from year to year. Memberships DO NOT automatically cancel at the end of the calendar year.
       
2.4 Charging Privileges:
 
(a) Subject to such restrictions and limitations as may be established by the Owner from time to time, the Owner will afford all members in good standing, and their families, the privilege charging for all food and beverage, retail and other purchases in the Clubhouse and on or about the Club facilities.
 
(b) Accounts will be billed on a monthly basis. All Members’ account numbers shall be placed on file in the office and in all service areas. The number will be used on all charge tickets. Members and families are required to sign all charge tickets.
 
(c) The Owner will also accept cash and credit cards in the Golf Shop and Food and Beverage outlets.
 
2.5 Member Accounts:
 
A monthly statement shall be sent to each Member, which will include a summary of all monthly dues, fees, charges, and other sums owing to the Owner. Statements will be sent on or about the fifth day of each month.
 
All statements are due and payable by the twenty-fifth (25th) day of the month in which the statement is rendered. If any Member’s account shall remain unpaid as of the twenty-fifth (25th) day of the month in which such statement is rendered, in addition to any rights and remedies which may be available to the Owner under these rules and regulations, the Owner shall have the right to suspend all charging privileges of the Member and his/her family.
 
If any Member’s account shall remain unpaid as of the twenty-fifth (25th) day of the month in which statement is rendered, such account shall be deemed delinquent and notice of delinquency shall be sent to each Member. If such delinquency is not cured within fifteen (15) days from the date of such notice, such Member may be subject to disciplinary action. Without limiting the remedies of the Owner in the event any member fails to timely pay to the owner any financial or monetary obligation to the Owner including, but not limited to, the amount set forth in any monthly statement, the Owner shall be entitled to institute and maintain a legal action or proceeding to collect such unpaid amounts… Additionally, all such unpaid amounts shall bear interest at the rate of one and one half percent (1½%) per month, or the maximum rate under Maryland law, whichever is less, commencing on the date such obligation was due and terminating on the date such amount is paid in full.
 
The Owner has the authority to take any other action that may be deemed appropriate to assist in the collection of Member’s accounts.
 
In the event any Member is delinquent in the payment of such Member’s account with the Owner on one or more occasions, in addition to all the rights and remedies which may be available to the Owner under these rules and regulations and other applicable laws, the Owner reserves the right to require the member to pre-pay dues, club storage fees, handicap fees and/or locker fees in advance, on an annual or other periodic basis as maybe amended from time to time.
 
Any expenses incurred by the Owner for checks returned by the Member’s bank or otherwise incurred in connection with delinquent accounts shall be borne by the Member. The Member shall also pay all attorneys’ fees and court costs incurred by the owner in connection with such collection.
 
Re-activation of a suspended members account will require back dated dues to be paid in advance of activating the membership.
 
Crediting of Account. All bills must be paid in full. The Members with any questions regarding his or her statement should contact the accounting department and any credits due the Member will be credited on the following month’s statement. Any disputed charges must be reported to the accounting office within 30 days of the statement closing date. Adjustments will not be made after 30 days. A credit may never be taken against any Initiation Fee.
 
Article 3
 
General Club Rules
 
3.1 Management and control: Owner and it, or its agents will manage and operate the Club and the Club facilities. As a result, the owner is solely responsible for the administration of the Club and the Club facilities and will have the exclusive authority to accept members, set fees, dues, and charges, established the rules and regulations and control the management and affairs of the club and the club facilities.
 
(a) Members are expected to abide by the rules and regulations of the club. Any violation of these rules and regulations may subject the Member to suspension or expulsion from the club.
 
(b) Any damage caused to the club facilities by the Members, their families or guests, shall be charged to the Member.
 
(c) Club employees have assigned duties within their departments. Members are not to request employees to perform any services not within their assignments. Employees who do perform such services are subject to disciplinary actions.
 
(d) Members are responsible for the conduct of their families and guests. Disorderly, abusive or destructive conduct makes the Member subject to discipline as determined by the Owner.
 
(e) Any complaints regarding club facilities, club staff, or the conduct of Members should be reported directly to the General Manager in writing. No criticism or reprimand should be made by a Member to any employee at any time.
 
3.2 Club Equipment:
 
(a) Property of the Club shall not be removed without the approval of the General Manager.
 
(b) Members shall be accountable for intentional and negligent misuse and damage to the Club property.
 
3.3 Off-Limit Areas: The golf cart storage area, golf course maintenance areas, golf shop desk, tee time area, kitchen and all other service areas are off-limits to Members unless accompanied by an authorized employee of the Club.
 
3.4 Food and Beverage Sales: All food and beverage consumed within the club facilities must be purchased from the club. Neither Members, their families, nor guests shall bring any food or beverage on the club facilities at any time.
 
3.5 Alcoholic Beverages:
 
(a) Alcoholic beverages may not be brought onto nor removed from the Club facilities at any time.
 
(b) All alcoholic beverages served or consumed at the club or on or about the club facilities shall be purchased from the club.
 
(c) No employee shall be permitted to accept alcoholic beverages from the Members.
 
3.6 Solicitation and Subscription:
 
(a) No subscription, petition or notice shall be posted in the Clubhouse without the approval of the General Manager.
 
(b) Personal information relating to any Member is confidential and the release of such information to any person is at the sole and absolute discretion of the Member.
 
3.7 Pets: No dogs or other pets are allowed on Club property, other than seeing-eye dogs. Members permitting dogs and other pets on or about the Club facilities are subject to suspension.
 
3.8 Games and Cards: The Owner shall have the right and power to prohibit any games, sports, or other activity which it may, in its determination, consider harmful to the interest of the general membership of the club.
 
3.9 Member’s property: The Owner will exercise reasonable care for the property of the Members but will not be responsible for damage or loss to property.
 
3.10 Reprimands: The General Manager will address violations of the rules and regulations according to the nature and severity of the violation.
 
 
Article 4
 
Clubhouse Rules
 
4.1 Dress: It is expected that Members will dress in a fashion befitting the surroundings and atmosphere provided in the setting of the Club. It is also expected that Members shall advise their Guest of the club’s dress requirements. The dress standards of the club may be waived by the General Manager for special activities and functions.
 
(a) Casual attire is permitted. Certain events may suggest jackets for men and comparable attire for women.
 
(b) Shirts and shoes are required at all times. Golf shoes with spikes must be confined to designated areas only. Golf shoes with hard spikes are not permitted.
 
(c) Blue jeans, in proper condition are permitted in the clubhouse ONLY! Non collared t-shirts are not acceptable at any time.
 
(d) Dress rules also apply to children and juniors of all ages.
 
(e) Cell phones are to be put onto the “vibrate mode” while in the grill room. Use of cell phones in the grill room should be done in an unobtrusive manner.
 
 
4.2 Locker Rooms:
 
(a) Lockers for all Golf Members and are subject to an annual rental fee, or the Club Plan, in such amount as determined by the Club from time to time.
 
(b) All clothing must be kept within lockers or designated areas.
 
(c) The Owner will not be responsible for articles placed in lockers.
 
(d) Clothing left lying in the locker room will be put into storage and if not claimed within thirty (30) days will be disposed of by the Owner.
 
(e) Storage of food and beverage in lockers is prohibited.
 
(f) Bath towels that are the property of the Owner shall not be removed from the locker room for any reason. Utility towels may be used outside the clubhouse, but shall not be removed from Club facilities.
 
(g) Objectionable behavior and profanity in the locker room will be caused for reprimand as deemed appropriate by the General Manager.
 
(h) No smoking in the locker rooms at any time.
 
4.3 Children: Children under the age of fourteen (14) must be accompanied by an adult who will assume responsibility for the behavior of the child while on or about the club facilities. The Owner reserves the right to cancel privileges of children if they do not abide by the club rules and regulations.
 
4.4 Parties/Reservations:
 
(a) The Club may sponsor various social, cultural and recreational events in which Members may be invited to participate. Activities will be publicized in Club bulletins, newsletters, email or posters.
 
(b) Reservations are required for most social events at the Club and are taken on a first-come, first-serve basis by pre-registering with the appropriate personnel of the Club. Cancellation of reservation after any published deadline for cancellation may result in the Member being charged a fee as determined by the owner from time to time.
 
(c) The Club encourages the use of club facilities by Members for private parties provided such parties do not interfere with the normal operation of the Club or with the services regularly available for Members. Members must make reservations with the appropriate Club personnel. The Member must assume full responsibility for the private event and for the conduct of such Member’s Guests in accordance with these rules and regulations.
 
Article 5
 
Golf Rules
 
5.1 Golf Registration: All Members must register in the golf shop before commencing play or proceeding to the driving range. Starting times may be called in or signed up in person, one week prior to the desired time.
 
5.2 Guests: Members of the Club may sponsor Guests to enjoy the Privileges of the Club in accordance with these rules and regulations. Although it is the intention of the Club to accommodate Guests without inconvenience to Members, the Owner reserves the right to limit the number of Guests that may accompany a Member on any given day. The Owner shall establish from time to time that daily guest fees, charges, and the Rules and Regulations for use of the Club Facilities by Guests. Guest privileges may be denied, withdrawn or revoked at any time for reasons considered sufficient by the Owner.
 
(a) Notwithstanding the foregoing, Members may not sponsor any one (1) person as a Guest to utilize the Golf Course more than one (1) time in a calendar month, regardless of who the host Member is.
 
(b) All Guests must be registered by a Member and must be accompanied by the Member at all times. No more than three (3) Guests may be introduced on the Golf Course by any Member at one time.
 
(c) On Saturdays, Sundays, and holidays, before 12:00 pm, Guests will be limited to one guest per Member.
 
5.3 Golf Rules and Regulations: Unites States Golf Association rules shall govern play at all times except as modified by local rules.
 
(a) Each player must have a set of golf Clubs.
 
(b) It is the duty of each Member to diligently assist in keeping the golf course in good condition. Divots shall be carefully replaced and pressed down. Ball marks on green shall be repaired and, upon completion of a shot, and bunkers are to be raked and smoothed.
 
(c) The General Manager, Head Golf Professional and other Club personnel are there to assure that Members receive maximum enjoyment from the use of the Golf Course. The General Manager, Head Golf Professional and other Club personnel act on behalf of the Owner in administering and enforcing these golf course Rules and Regulations.
 
5.4 Allowable Groups:
 
(a) Members are encouraged to play in foursomes. The golf shop may approve fivesomes and they are expected to keep their pace of play on the golf course. Six or more in a playing group are not allowed at any time.
 
(b) The owner may establish restrictive starting times for golf on any reasonable and nondiscriminatory basis.
 
(c) Tee time arrangements that are made for groups of twenty (20) or more people shall constitute a tournament and will require approval by the General Manager, Head Golf Professional or appropriate Club personnel.
 
(d) Outside tournaments are a necessary part of operating a successful golf operation and may be held on Mondays when the course is closed to Members.
 
5.5 Starter: The starter has the authority to govern starting times of all play and will have sole authority to make up foursomes wherever needed.
 
5.6 Walking: Members may play the course while walking and carrying their own clubs. Pull carts are permitted but must remain off of tee surfaces, green surfaces and collars.
 
5.7 Slow Play: Golf is more fun when played with dispatch without delay. All rounds shall be completed as promptly as possible. When one hole becomes open ahead, the following group shall be allowed to play through. A single player has no priority in terms of speed of play.
Club representatives monitor all play and subsequent requests to alleviate slow play will be adhered to. First warning, group that is behind will be asked to catch up with pace within 2 holes. Second warning will result in players picking up their ball and moving into the required position. Third warning will result in discontinuation of play for the group.
Consistent Slow Play by individual or groups may result in the loss of the preferred tee time privilege as set forth by the Membership Committee.
 
5.8 Power Golf Carts:
 
(a) The Owner shall maintain a fleet of power golf carts for the use of Members in accordance with the terms and conditions of these Rules and Regulations.
 
(b) Golf carts shall not be used by a Member without proper assignment and registration in the golf shop. Golf cart rental is on a first-come, first-serve basis.
 
(c) Power golf carts are not to be used by more than two passengers. Only two golf bags are permitted on a power golf cart at a time. Operators will follow the “rules of the day” as it pertains to cart operation.
 
(d) Operation of a golf cart is at the risk of the operator. Members will be held responsible for any damage to golf carts while in their possession and for any damages to the golf course resulting from such use of the power golf cart.
 
(e) Golf carts may be operated by juniors age 16 and above, provided that the operator holds a valid driver's license and has parental approval. Juniors age 18 and older do not require prior parental approval.
 
(f) Directional arrows must be followed and golf carts are permitted no closer than 30 yards from the greens. Golf carts must not be driven on tees, aprons, green surrounds or in bunkers.
 
(g) Golf carts are not allowed to be used off the golf course.
 
(h) All golf carts must be returned to the clubhouse upon completion of either 9 or 18 holes of play.
 
(i) Each Member desiring to utilize one of the Club’s power golf carts must first execute and deliver to the owner a Golf Car Rental Agreement, as the same may be amended from time to time. Each Member, and each qualified person in their family, may execute a single Golf Cart Rental Agreement and any amendments thereto, which will cover all future golf cart rentals.
 
5.9 Driving Range:
 
(a) To preclude injuries, it is imperative that players tee up at designated tee mats and do not go on the driving range beyond the markers.
 
(b) Children under the age of 16 must be accompanied by a Member or golf shop personnel, except those with established handicaps or prior golf shop approval.
 
5.10 Practice on the Golf Course: Only the driving range and practice green areas can be used for golf practice. Tees, greens, sand traps and fairways of the golf course may not be used as practice or lesson areas.
 
5.11 Dress:
               
(a) A dress code is essential to preserve the tradition and integrity of the game. Members should realize that it is not possible to stipulate exactly the type of clothing which is appropriate, but all Members agree to abide by the intent of the Rules and Regulations and cooperate accordingly.
 
(b) Golf shirts must be worn, and tucked in on the golf course, driving range and putting greens at all times. Proper attire, as determined by the Owner, will be mandatory for everyone using the Club facilities.
 
(c) Acceptable clothing includes; long slacks, proper length Bermuda shorts, golf shirts, sweaters, jackets, and wind/rain suits. Acceptable golf shoes must be worn at all times. Men must wear shirts that have collars and sleeves. Women must wear shirts with slacks, skirts or proper length golf shorts. Proper length is defined as no shorter than one fist above the knee.
 
(d) Jogging/workout clothes, denim or designer (any color), stonewashed jeans, halter tops, short shorts and bathing suits do not constitute proper golf attire.
 
(e) Soft spikes are required on all golf shoes. It is the responsibility of each Member to inform their guests of the dress code and soft spikes requirement and ensure that proper attire is worn.
 
(f) Juniors must conform to the Club dress code.
 
5.12 Junior Play:
 
(a) The children of Members under the age of 18 may be present on the golf course if accompanied by a Member, in possession of their own set of golf clubs and occupying one of only two seats in a golf car.
 
(b) Children of Members between the ages of 14 and 17, have established handicap or prior approval of the Head Golf Professional or Club may play without a Member. Approval may be withdrawn by the Head Golf Professional or Club personnel at any time due to the result of disobeying the rules as set forth, without prior notice to the Member.
 
(c) Tee time reservations for Juniors allowed to play without a Member are subject to approval of the Golf Shop depending on daily course activity.
 
5.13 Handicaps:
 
(a) Handicaps are computed under the supervision of the Club personnel in accordance with current U.S.G.A. recommendations.
 
(b) Accurate records of scores are to kept and recorded for all full and 9 hole rounds played. The Head Golf Professional, along with the Membership Handicap Chairman will determine if there are any violations by Members in submitting their scores. If there are violations, the Head Golf Professional will have the authority to enforce M.G.A. and U.S.G.A. recommendations for scores not posted.
 
 
5.14 Weather Conditions:
 
(a) The Owner may close the golf course to play for adverse weather conditions and for maintenance purposes or when the course could be damaged by play. If lightning is in the area, all play shall cease.
 
(b) Credits will be issued for discontinued play. If less than 3 holes were played, an 18 hole credit will be issued. If more than 3, but less than 12 were played, a 9 hole credit will be issued.
 
5.15 Miscellaneous: No wading in lakes is permitted. Balls may be retrieved only from the banks of lakes.
 
 
Article 6
 
Swimming Pool Rules
 
6.1 Rules and Regulations: The Swimming Pool Director, lifeguards, and certain other Club personnel are there to assure that Members receive maximum enjoyment from the use of Swimming Pool. The Director, lifeguards, and certain other club personnel act on behalf of the Owner in administering and enforcing these Swimming Pool Rules and Regulations. Please Cooperate. Disciplinary action resulting from infractions of the Rules and Regulations shall be administered at the discretion of the Director, lifeguards, and certain Club personnel. Also, see swimming pool rules as they pertain to the current pool season under another heading distributed at the pool registration desk. These rules supersede rules printed below as it pertains to the instruction and direction of the lifeguards.
 
6.2 Registration:
 
(a) All Members must register at the Swimming Pool registration counter before commencing swimming or entering the Swimming Pool area.
 
(b) Use of the Swimming Pool will be permitted only during the official hours of operation, as determined by the Owner. The Swimming Pool area will be patrolled and trespassers will be subject to a fine and other such disciplinary action, as the Owner deems appropriate.
 
6.3 Guests: Members of the Club may sponsor guests to enjoy the Privileges of the Club in accordance with these Rules and Regulations. Although it is the intention of the Club to accommodate Guests without inconvenience to Members, the Owner reserves the right to limit the number of Guests that may accompany a Member on any given day. The Owner shall establish from time to time the daily Guest fees, charges, and Rules and Regulations for use of the Club facilities by Guests. Guest privileges may be denied, withdrawn or revoked at any time for reasons considered sufficient by the Owner. All Guests must be registered by the Member and must be accompanied by the Member.
 
6.4 Dress:
 
(a) A dress code is essential to preserve the family atmosphere of the Club. Members should realize that it is not possible to stipulate exactly the type of attire, which is appropriate, but all Members agree to abide by intent of the Rules and Regulations and cooperate accordingly.
 
(b) Acceptable swim attire is defined as contemporary but not revealing.
 
(c) Swim attire is to be covered by appropriate outerwear when entering or leaving the Swimming Pool complex.
 
(d) Members and their Guests are not permitted in the Clubhouse in swim attire. Restrooms are available at the Swimming Pool.
 
(e) Bathing caps are recommended for persons with long hair.
 
(f) It is the responsibility of each Member to inform their Guests of the dress code and ensure that proper attire is worn.
 
(g) Juniors must conform to the Club dress code.
 
6.5 Children:
 
(a) No child under the age of twelve (12) will be permitted to use the Swimming Pool unless accompanied by a responsible adult.
 
(b) A child unable to swim must be accompanied in the Swimming Pool by an adult who is also in the Swimming Pool, in a swimsuit, and is responsible for the child’s care.
 
(c) Baby-sitters must be at least thirteen (13) years old, able to swim and must attend the child at all times.
 
(d) The swimming Pool restrooms are to be utilized to change and attend to small children.
 
(e) Children that are not toilet trained are not allowed in the Main Pool at anytime     
 
6.7 Maryland Sanitation Law:
 
(a) Any person using the Swimming Pool must take a shower prior to entering the Swimming Pool. If suntan oils or lotions have been applied, another shower is mandatory before entering the Swimming Pool again.
 
(b) Any person with a communicable disease, skin lesion, foot infection, sores, or inflamed eyes, mouth, nose, or ears may not enter the Swimming Pool.
 
6.8 Swimming Pool Etiquette:
 
(a) Glass bottles or containers of any kind (bottled beverages, baby oil, etc.) will not be permitted inside the Swimming Pool area.
 
(b) Persons under the influence of alcohol are not permitted in the Swimming Pool area.
 
(c) No loud or boisterous conduct or horseplay is permitted in the Swimming Pool or surrounding areas.
 
(d) Group games must be approved by the Swimming Pool Director or lifeguard.
 
(e) Radios and tape players are prohibited unless individual earphones are utilized to listen to them.
 
(f) Running in the Swimming Pool area is strictly prohibited.
 
(g) Sitting, climbing, or jumping off the lifeguard towers is prohibited.
 
(h) Skateboards, scooters, and bicycles are prohibited in the Swimming Pool area.
 
(i) Pets are not permitted in the Swimming Pool area.
 
6.9 Weather Conditions: The Owner may close the Swimming Pool for adverse weather conditions and for maintenance purposes. If lightning is in the area, all use of the Swimming Pool shall cease.
 
 
Article 7
 
Changes to Rules and Regulations
 
The Owner may, from time to time, establish such rules and regulations for the control and operation of the club and of all of the club facilities. The Owner has the right, at any time and from time to time, to amend, modify, and change these rules and regulations as it deems necessary, in its sole and absolute discretion. Any prior understandings or agreements regarding any of the matters discussed or contained in these rules and regulations are hereby superceded by these rules and regulations dated as of January 1, 2005.
 
 
Article 8
 
Liability for use of property

Each Member shall be responsible for any damage or destruction to the club facilities or any of the real or personal property located thereon caused by such Member, or by their respective family or guests. Payment for damages shall be collected in the same manner as that in which other debts or obligations are collected under these rules and regulations and failure to pay such amounts in a timely manner shall have the same effect as any infraction of these rules and regulations.
 
 
Article 9
 
Indemnification and Assumption of Risk
 
Each member hereby agrees to indemnify, defend and hold the Owner (and its parent affiliates, shareholders, directors, partners, officers, employees, and agents) harmless from and against any and all liabilities, costs (including reasonable attorney’s fees), claims, demands, or damages incident to or arising out of facts and omissions of a member, or by their respective family or guests. Each Member hereby voluntarily assumes all risks of accident or damage to a member’s person or property, and the person or property of their family or guests, arising out of or relating to the use or occupancy of the club facilities by a member, and their respective family or guests.
